Succeeding to a tenancy

In the event of a tenant dying, the remaining joint tenant or the tenant's partner can succeed to the tenancy. This means they automatically take over the tenancy, provided they have been living in the same property at the time of the tenant’s death.

Only one succession is allowed, so if the tenant who died had succeeded to the tenancy, then no further succession right exists.

In exceptional circumstances, we may allow someone to succeed who is not the joint tenant or partner. This is at the discretion of Broadway Living. As part of a discretionary succession, we may require that someone moves to a smaller property that meets their needs.
