Listing an asset

How is the decision made?

Once the local authority receives a nomination, it has eight weeks to make a decision. If it decides that the asset meets the criteria and has been nominated by an eligible organisation, the asset is added to a list of “Assets of Community Value”.

All listed assets should also be included on the local land charges register.

A list of unsuccessful nominations should also be maintained by the local authority. Both lists are publicly available, and will be available on the council’s website as and when nominations are made.

Informing stakeholders

If the decision is to list the asset, the local authority will inform:

  • the nominating organisation
  • the owner of the asset; and
  • the occupier of the asset

If a nomination has been unsuccessful then the organisation who made the nomination will be informed in writing, and will be told the reasons why the nomination has been unsuccessful.  

Appeals

An owner whose asset has been listed as being of community value can appeal against the listing by asking the local authority for an internal review. The request for an internal review must be made within 28 days of the owner being informed by the local authority. Any internal review will be held within sixw weeks of being requested, and will be considered by someone more senior than the person who made the original decision.

If the owner is not satisfied with the result of the internal review, they may appeal to an independent tribunal.
