Apply for a prison related empty property exemption (Class D)

A property may be exempt if no-one lives in it because the person who usually pays council tax is in prison or detained in a hospital.

Before you start

Apply if the person who pays council tax has been detained or imprisoned due to:

  • An order of a court
  • Being in custody under military law
  • Being remanded in custody
  • Being detained under a Mental Health Act.

They will not get the exemption if they are in prison for not paying council tax or a fine.

You will need

  • A copy of the order, if the person has been detained under the Mental Health Act
  • Letter confirming detention or document showing prison number, if in prison

Uploading supporting documents

We may ask you to upload some documents.  

  • Accepted file types: Word (docx), Acrobat (pdf), Excel (xlsx), Plain text (txt)
  • Zip files can't be uploaded
  • We also accept photos taken on phones and tablets and the following image file types - jpeg, gif, png
  • There is a maximum individual file size per document of 50MB

What happens next

We will write to confirm detention and send a new bill showing any changes.
