Ealing Council process your personal data in respect of parking and moving traffic contraventions because we have a statutory duty to enforce parking regulations

What kind of information does Ealing Council have about me?

Personal data is collected by Ealing Council in order to serve a Penalty Charge Notice (PCN), notice to owner, charge certificates and enforce parking contraventions, moving traffic and bus lane contraventions. Data can also be collected for the purposes of issuing permits and vouchers to the public, which will include payment details.

Your personal data may be collected, processed, shared and retained in order to carry out the performance of a public task and fulfil our legal obligations.

Your personal information may include but is not limited to:

  • Details of your vehicle such as vehicle registration number, vehicle make and model.
  • Vehicle registered keeper details such as name and address from the DVLA or hire/lease companies.
  • Contact we have had with you, such as any correspondence via email and post.
  • Images captured by the council’s civil enforcement officers (CEOs), CCTV enforcement vehicle or those captured by automatic number plate recognition (ANPR) and CCTV cameras.
  • Call recordings and notes/transcripts of telephone calls made to the council.
  • Some transaction information if you have paid for a parking service by credit or debit card.
  • Contact details you have supplied such as email address, telephone number etc.

What do you do with information about me?

The council of the London Borough of Ealing will use the data collected for the following reasons:

  • The issuance and administration of PCNs.
  • Enforcement action for PCNs that remain unpaid, with our debt collection agencies and law enforcement agents.
  • For the prevention and detection of crime, and when otherwise legally required, such as blue badge fraud.
  • Processing of permits and vouchers.
  • Statistical reports.

Your information may be:

  • Shared with third parties for appeals and enforcement, such as London Tribunals and the Traffic Enforcement Centre (TEC).
  • Shared with organisations such as British Parking Association (BPA) and London Councils for statistical purposes only.
  • Shared within departments of the council where it is essential to carry out statutory functions.
  • Shared with our contractors in order to carry out our legal obligations. These include providers of services such as our cashless parking system, IT system, parking enforcement and print and scanning providers.
  • Shared with the police and law enforcement agencies.

The council does not use or share your data with third parties for marketing purposes.

How do I know the information about me is kept safely?

All the information the council collect is stored securely on our IT systems and manual filing systems. We have strict procedures for the way this is done. Any and all information about you is treated as confidential and with respect. There are also clear rules and guidance about storing, recording and sharing information which staff receive training on.

We take information sharing very seriously. Appropriate council staff are DBS (Disclosure and Barring Service) checked. Any member of staff who is found to be breaking the rules will be dealt with through appropriate disciplinary procedures.

Are the records confidential?

All Ealing Council employees have a duty of care in accordance with our data protection policy. This includes respecting that right to confidentiality.

For how long are records held?

There are different rules for different documents and/or information kept by the council. We are required by law to keep records for varying lengths of time depending on individual circumstances. PCN data relating to an individual will be stored for a period of up to two years or as long as cases remain outstanding.

Don't you need my permission to keep and share information about me?

We would need your consent if the council’s legal basis for collecting and processing your personal information is consent.

Although your information is confidential, we may have to share information about you/your family without your permission. These reasons are:

  • To prevent or detect a crime
  • To comply with a legal obligation

Are there any laws applicable in the processing and protection of my information?

There are a number of laws which allow for the protection, collection and processing of your personal information for this purpose, such as:

  • The General Data Protection Regulations and The Data Protection Bill 2018
  • The Human Rights Act 1998
  • London Local Authorities Act 1996 (as amended)
  • London Local Authorities and Transport for London Act 2003 (as amended)
  • Traffic Management Act 2004 (as amended)
  • Road Traffic Act 1991 (as amended)

Can I see the information you have collected about me/my family?

Yes, you can request a copy of the information held. This is called a subject access request under the Data Protection Bill 2018 and General Data Protection Regulations (GDPR) which contain certain rights of individuals and their personal data.
