Protected trees

Apply to carry out works on a protected tree

Any tree growing within a conservation area that has a trunk diameter greater than 75mm (when measured at 1.5m above the ground) is protected by conservation area legislation.

If you are intending to prune or remove any trees protected by the legislation, you have a legal duty to notify the council’s planning department six weeks in advance of your works.

Apply to carry out works on a protected tree through the Planning Portal.

If you carry out tree works without notifying the planning department, you could be prosecuted under the Town and Country Planning Act 1990 which could result in an unlimited fine.

Fast-track service

A fast-track service is available for tree applications in a conservation area that meets the criteria in the 'acceptable conservation area pruning' list.

What the council will do after receiving a tree works application

We will respond in one of three ways:

  • allow the proposed works
  • discuss and agree alternative works in the interest of good tree management
  • serve a TPO to prevent the proposed works

We will send a receipt acknowledging your application. If you do not receive one, please contact the planning department at Planning@ealing.gov.uk or tel: (020) 8825 6600. The receipt letter will advise you of the end date of the notice period. If you do not receive any further correspondence you may proceed after this date. You should keep a copy of the receipt letter as evidence of your application.
